Title: Notice to quit rental apartment

Going through this and searchign for an apartment. Dont feel I did anythign wrong but landlord wants unit I am in back for his daughter. havent found anything yet and is taking ages. Have to be out in 2 weeks or risk going throught he courts.Any advice?

I hope you find something soon. Do you have family you can stay with temporarily?  You could always put your belongings in storage until you find another apartment.

That is a total drag! Sorry you have to go through this. I was abruptly asked to vacate my residence in Wisconsin at age seventeen. It was March-still pretty cold at that time. I was working three jobs and going to school so I really only had about six hours of the day to worry about. I moved my belongings into a storage shed, lived in my nineteen seventy volkswagen bug f three to four nights and slept in a warehouse that I was working at the other nights for six or seven months. I would sleep over at a friend's house once or twice a month. I had a gym membership which gave me access to a daily shower. I saved enough money during those homeless months, to put a down payment on a house, which started me on the road to bigger and better real estate deals.

    The problem with apartment rental is: If they do not like you, they will show you the door.
    Or they will make your life so miserable...that you will be forced to move.
    So, many are choosing the homeless shelters or camp out in good weather.
    Sad...very sad but true!

I'm so sorry to hear this.  Did you are a lease?  If it's month to month he can make you move, but not if you have any kind of lease.  Is there any friend of family member you can stay with?

Sorry Go Find Your Rights. The Landlord can't just kick you out (if you are doing everything in contract), Landlord must give you time to save for your next or pay for your move look into this.

No they don’t.  You don’t own the property. They do not have to let you live there while you supposedly look for somewhere else or wait until you find something. If you do not have a lease you have nothing and even with a lease they have things worded so the property owner is covered.

He has to give you thirty days notice.  It is the law.

Hi, he told me in nov 22nd 2018 and got the 30 day;I tenant at will since 2009; Started packing stuff in boxes and vacated some rooms. i could move back to my father but he wanted me out in first place. even if i move back I would have to give yp my pet cat as his place has no pets policy. Waiting on apt i saw wednesday for cheaper rent but not heard back yet. Taking forever due to my low credit scores. I work two jobs, almost three but was laid off from usps back in 2016 and fell behind;there were some layofffs before that but now on firm grd jobwise. Just wish this was quicker.

My hope is that it takes about another month before going to court and then maybe asking judge for more time. I acknowledge I cant stay but 90 days with poor credit is harsh.

The judge cannot do anything if you have a written agreement. Also, it is required by law that you have a certain amount of days WRITTEN notice because no he cannot just put pressure on you and make you leave. Is it possible to take an emotional appeal or try logic to discuss with your landlord the issues and why this is happening??? Otherwise, your plan for delay in the courts might give you just enough time! I do hope it works out for you!

When we have tried to evict people from properties it has taken up to a year to get them out.  So maybe if you talk to the landlord and let him know you are trying he will give you another month.

not sure if that is a valid reason to kick you out and I believe there is a mandatory time period unless you have done something wrong which doesn't appear to be the case...good luck!

No it isn't. Just because everyone says it does not make it a law.  It may also depend on what state you live in. If you do not have a contract they can give you as little as 7-21 days.

If you have known since November of last year then you have had almost 6 months to find somewhere else to go. Your OP makes it sound like he gave you a 2 week notice.  It is HIS property.  It doesn't matter why he wants you out.  If it is for his daughter or whatever.  He owns the property.  It will be harder to find something where they will allow you to have a pet.  I am curious as to why your father does not want you to live with him.

:heart:   :in-love:   :kiss:   :heart:  This situation may not be in your best favor, if they give you a written notice, than they can kick you out of their place. I've seen to many apartment complex's where they place the tenants stuff outside on the ground to vacate the apartment. My advise if this owner/manager is ready for you to move out, get your stuff out asap or you may lose it to others or the weather.  :heart:   :in-love:   :kiss:   :heart:

If you have a lease and landlord is breaking, try calling legal aide for assistance or your local housing department at best they might be able to get you into a shelter until you can find something. I hope things work out for you.

If you had a lease and its still active you don't have to leave until it expires...if your lease is expired you're out of luck... :(

Before I got married a few years ago, I lived in an apartment.  Everything started out just fine but over the years, things went downhill in a hurry. 

I could not wait to get out and when I gave the landlord my notice it was him who was very upset that I was leaving.  Apparently I was a pretty good tenant.  LOL  ;)

Since my departure, almost 7 years ago, there have been about 3 other tenants living at that apt. 

In my case it was the other way around, the landlord wanted me to stay but I could not wait to leave.  It doesn't look as though I will ever have to be in a situation where I will have to rent again and I hope beyond all hope that I never do.

I hope you find a place. Don't give up things always turn out for the best. I was able to find a place in 3weeks. Just stay positive and you will figure something out.

Not really a good idea in this case (unless there are other details the OP is leaving out). 30 day notice in November + no long term lease = zero basis to prevent the eviction.  In spending money on an attorney, you are only out even more in the end with no benefit gained for doing so.

No you don't.  It isn't your property. This is one of the reasons I would never rent to anyone. Oh I have rights. I can stay in your house and not pay you rent and just live here because I want to.  YOU DO NOT own the property.  If they tell you to move out then you gotta go.  You can find somewhere else.  If NO ONE in your family will take you in and NO ONE will rent to you then there is a reason why.

If you have a lease agreement I don't see how he can do this unless there is some kind of complaint or there is a problem with late payments

See if you can find a deal for new customers for a storage unit. Put your things in storage and see if you can find an airbnb to rent for a few weeks to a month until you can find a place.
