Take them to small claims court...you can go to your local court house and I think you would see the magistrate and file a claim...the other person will be served with a court date....good luck

I was hit two weeks ago when a car reversed into me not my fault and they said they did not have insurance "on them" but when i got police report finalized after 2 long weeks they said she still did not have insurance !!! does anybody know what i should do. I do have insurance my car is not terrible it is still fully functional but I do not want to pay a 500 dollar deductible because it is not my fault but she has no insurance so cant pay what do i do???? Just leave the car as is then if i do not want to pay deductible ?

Depends on the cost of "repair".  Find out what the maximum allowed to sue in small claims court and then proceed from there.  Of course, even if you "win" in court it may take a while to get the money to fix your car but at least they will be paying the bill and not you.  If you can't go through small claims court well, then you really need to speak to a lawyer.  Good luck!!!

You will probably have to pay your deductible to get your car fixed & then take her to court.  If she can't afford insurance, I doubt if you will get much out of suing her, either.

With the number of uninsured motorist there are, I make sure to pay the uninsured motorist package on my car. I have been hit before by an uninsured motorist (luckly just took the bumper off which I was going to put a body kit on my car at the time anyways) but now I am driving a brand new car and don't want to deal with any accidents to it.

How about a hit and run, when you don't know who hit you and they never come forward. That is even worse, and then they put you in a wheelchair.

i feel for you i was in a wreck 2 weeks ago today..they are having to do a policy investigation on her to see if her insurance was in effect at the time of the accident.we had a wheelchair carrier on the back of the blazer which took most of the hit.except for me no one in the car was hurt..i have a sprained thumb,severe bruising on shoulder and bruised left hip..my 11 yr old granddaughter was sitting behind me.she,along with my husband never got hurt..mine needs to have the wheelchair carried and the bumper replaced.and like you if she dont have insurance i have to pay.and its not fair to have to use my insurance because she was too lazy to pay her bill.and i know things come up,but there are some bills that just take priority over others.I hope all works out for you...

If the cost is less than the deductible, pay it yourself, if not, then go through your insurance.  I think you could technically sue as well, but if they don't have anything you probably won't get anything.

Not having insurance does not abrogate the one in the wrong from liability. You can sue them in small claims court fairly easily and for very little cost to file. That is probably the best solution, but it does not guarantee you getting paid. However, getting a judgment against them will make their lives considerably more difficult so that might be a 'win' for you. If they are just plain deadbeats, you more than likely are stuck, most jurisdictions just don't bother to go out and seize property for settlements, although that is part of their job...  :-[

Our insurance company would pay the damages and they would sue the uninsured driver to recover the money.

Do you have uninsured motorist coverage? If so it should cover any damages to your vehicle.

You should contact your insurance co and they will find out who the other ins. co is and get them to pay to fix your car so they won't have to.  May take some time but will sure save you from having to pay that deductible.  Good luck with it!

I believe it varies from state to state, so that is something that should be asked of your agent.

ME and my Family where Involved in a car accident last summer. The Guy went left of the center lane and smashed into the back driver door. If my husband hadn't gotten out of the way that he had, my husband more than likely would not be here. Turned out the guy who hit us was driving on a suspended license. In someone else car with no insurance on the car, registered to an invalid address. But wait it get better i pulled the driver record up on the court sites. He had at least 8 violations going back at least 10 years of Driving on a suspended drivers licenses  Can you say  :BangHead: :BangHead: :BangHead: :BangHead: :BangHead:.But my husband daughter and I are all fine. and my lovley angel that night made me laugh. We were headed to a carnival when we got hit. While we were standing on the side of the road she saw a the metro bus going up the street and said " Daddy car broken, can we take the bus to the carnival."  :angel11: :angel11: :angel11: :angel11:
