Topic: should first time 30+ older people be incarcerated or given probation for felony  (Read 1614 times)

I think that if someone has gone 30 years or more without any criminal record probation should be given. Now obviously I would say this would hold true for crimes less than Rape, murder,molestation etc.If they were to commit a felony theft out of desparity, would prison actually rehabilitate or cause them to get out and hate the system leading them to then live a life of crime. I believe the later that, they would become a criminal. I think probation would be enough for them to realize what their mistake almost cost them.

well a felony is a felony  if its first time and not real serious a lawyer can get it Reduced  and im sure the courts would consider a first time offender

I know of a story that they gave a 60 year old jail time and he never had dont nothing his whole life so I guess a felony is a felony no matter what

I think it depends on your crime. Just because you were never caught the first 30 years doesn't mean you were necessarily a good, honest citizen. I'm in San Diego and there's a senior citizen running around robbing banks (they call him the Geezer Bandit lol). Does he have a criminal record? Maybe, maybe not. But he's hit up a few banks over several months now and most recently he showed a gun. If he ever gets caught, I doubt anyone would be satisfied with him only getting probation (even if he is a senior citizen).

take into consideration that approximtly 35 % of the people in prison today are innocent of the charges that got them there.  before anyone goes crazy, yes I do beleive that we all should be held accountable for our actions but everyone is different, and have different circumstances and these should be taken into account when the judge hands down a sentence.
